- The hirer confirms that they can competently swim a minimum of 25 meters unaided and that they will wear a leash at all times.
The hirer confirms that they do not suffer from any medical conditions, or that they are not taking any medication / drugs, that could affect their ability to part-take in SUP boarding activity.
The hirer agrees to use the equipment only in the manner intended and the purpose for which it was designed.
The hirer acknowledges and agrees that the equipment is in good condition in all respects, and undertakes not to misuse it and to return it with all accessories in the similar condition as when received.
The hirer will immediately notify Mistral Hayling in the event of any loss of the equipment.
The hirer shall cover Mistral Hayling in respect of all costs, claims, expenses and demands which it may suffer or incur, and which arise directly or indirect out of the use of the equipment during the period of hire.
The hirer acknowledges that by taking advantage of Mistral Hayling’s offer of the use of its equipment, if damage is caused to that equipment whether by their negligence, deliberate or accidentally actions that, by signing this agreement, they agree to pay for any damages to the equipment or the full price for the replace of the equipment, if lost or damaged beyond repair.
The hirer understands that neither Mistral Hayling nor its employee’s accept responsibility for any loss, damage, or injury suffered by persons and / or their property arising out of, or during the course of activities whilst hiring. Mistral Hayling also will not accept liability for any damage or injuries suffered to any person(s) and / or property by the hirers actions, be these said actions accidental or deliberate nature.
INSURANCE- Mistral Hayling confirms that it is covered by public and employers liability insurance; however, we offer no insurance cover regarding personal accidents to individuals that may occur during the term of this hire agreement. Watercraft activities by definition involve an element of risk. It is in your own interest to take out insurance cover against accident, emergency rescue, and person injury, loss of luggage, equipment damage and cancellation.
Cancellation- Mistral Hayling requires 24 hours notice to cancel a booking for any reason. Less than 24 hour notice will not be sufficient to be able to give you a refund. If for any reason Mistral Hayling decides to cancel hiring for instance due to poor weather conditions, hire charges alone will be refunded.
Mistral Hayling reserves the right to refuse or immediately terminate a hire. The disclosure for the reason for this action will be entirely at Mistral Hayling’s discretion.
Return: Please be back on time or an additional charge may be applied. For full day hire, all boards must be back by 4pm.
